CBR MODELS THE LIES TOLD BY THE PRO-LIFE MOVEMENT

LATEST UPDATE: January 7, 2008. As you will see if you read the article below, it has been over three months since CBR began to threaten to sue us and it turns out their threats were simply another instance of the lies CBR tells people. They have not sued us. No papers have been served. CBR, by their actions, continues their leadership in this latest iteration of "Christian pro-lifers" who say they will do one thing, then do another and have no more sense of sin than a dog who returns to eat his own vomit.

THE CONTEXT

In October 2007, The Center for Bio-Ethical Reform (CBR) censored two of my music videos from the Internet because I had refused to sign a contract that CBR requires people to sign before CBR will give them permission to use images of dead babies that CBR claims to own. To thwart their censorship, we deleted those images from one of the videos and republished it on the Internet on Youtube. See the video here.

Today we got a message from CBR accusing us of lying about them in the new video. So now they are threatening to sue us for, well, read their message for yourself:

Mr. Horsley:

Your recent post at http://www.youtube.com/watch?v=lDoEQTWycLU contains a false statement, known by you to be false, concerning the terms by which CBR licenses the use of images to which it holds copyrights. The statement falsely accuses CBR of forbidding the use of our images "until we pay them what they require." The statement goes on to accuse CBR of "selling images of dead … babies."

We have earlier communicated to you, in writing, the fact that we do not charge any fee to applicants for license to use our images. We have explained to you, in writing, that our only requirement for use is that applicants provide written certification of their willingness to condemn violence against the persons and or property of abortion providers and their willingness to avoid involvement in anti-abortion activity with anyone who refuses to condemn such violence.

The publication of a false statement which damages the reputation of another is defamation and is actionable in a court of law. If you do not immediately remove from the above referenced website URL what you know to be a false statement concerning CBR's licensing policies, we will proceed with appropriate legal action.

This is my reply:

To David Sutherland, Mark Cunningham, and all others involved with CBR:

Payment involves any form of remuneration, including what you, in your recent email, call "written certification," which is a form of service. In other words, you require me to pay you by signing a contract before you will give me use of the best available images of the abortion holocaust. That contract requires me to condemn "abortion related violence" and to not associate with anyone who refuses to condemn "abortion related violence." If I sign that contract, I am honor bound to serve you not only in my thoughts and words but in the actions I take in association with other people. That is payment in every sense of the word. If you and the rest of the evil cabal of lawyers around you haven't learned that, then you will learn it when we meet in court.

I fully expect to meet you in court because I have no doubt you actually believe that you do not require people to pay you when you force them, for the use of the images, to sign a contract that governs their subsequent thoughts and actions involving "abortion related violence." The evil that people do is often hidden from their conscious mind and from their conscience. That is how Satan keeps them yoked to evil. The fact that you refuse to see the payment that you require from every person who uses the images of dead babies that you have accumulated proves the evil that lives in your souls.

If you don't believe anything else I say, believe this: Evil people like you will not own my conscience. My conscience is already owned by One who even now is moving to destroy your power to control the minds of God's people by cunningly manipulating them into signing a contract that allows you to dictate what they can think about "violence," about the use of force in this world. That evil power is being destroyed as we speak.

(Christian Gallery News Service, Sept15, 2007) Neal Horsley is a member of a group of candidates for Governor of various States, all of whom are committed to using the power of State governments to nullify laws legalizing abortion in their States. Neal Horsley's problem with CBR (the Center for Bio-Ethical Reform, the California pro-life organization controlled by Gregg Cunningham) occurred because CBR requires that people who use the images they hold copyright on must sign a contract that binds them to look to CBR as the arbiter and definer of what the contract signer is allowed to say about "abortion related violence." Because of the actions that might be required before the State of Georgia could effectively interpose the power of the State in defense of unborn babies slated for death, any promises Horsley makes about the use of violence go directly to the heart of his ability to implement the strategy that he embodies to defend the babies. Therefore he could not, in good conscience or in good faith, sign CBR's contract. In spite of Horsley's reasons for refusing to sign their image use contract, CBR has had Horsley's songs taken off the Internet and, as the letter below indicates, are planning on taking him to court to punish him for using the images of dead babies that CBR claims to own.

Following is a message Neal Horsley sent to several thousand people who monitor his abortion abolition work. He wrote,

I learned of this attack when I received the following message from the Center for Bio-Ehtical Reform:

From: David Sutherland
To: Neil [sic] Horsley
Sent: Friday, September 14, 2007 4:10 AM
Subject: Horsley - YouTube DMCA video take-down notice


Dear Mr. Horsley,

As a authorized agent for the Center for Bio-Ethical Reform I have requested YouTube remove three of your videos as they contain unauthorized and infringing video or still photos of which the Center for Bio-Ethical Reform owns an exclusive right. If you are publishing or distributing any other materials that contain our material immediately pull these items from distribution or use and remove any content containing our video or still photo material from any sites you have posted them to.

You are not authorized to use any of the aborted fetus video or still photos owned by CBR in any way. This is not the first time we have communicated the need for you to license the materials we expect you will take this refusal seriously. Future use of our materials without a signed agreement will result in legal action.

If you have questions as to our licensing requirements please feel free to contact me;
I expect full and immediate compliance in regards to the current use our materials which you may be utilizing.

As soon as I read that message I went to Youtube and my song "Father Abraham" at http://www.youtube.com/watch?v=yOJu2e5ECWw  was no longer viewable.  CBR also had the song entitled "Babies Blood on Georgia" taken off the Internet. The songs were my heart's cry in defense of babies being torn limb from limb in this nation. In the few days those songs had been online, hundreds of people had viewed them and responded by telling me they were some of the most powerful reminders of the horrible holocaust going on around each and every one of us each day that passes. As things now stand, I lack the resources to stop CBR from destoying my attempt to stop people from butchering babies alive. Please read on to see whether you might want to help me in this fight.

When I realized my videos were being taken down, I sent the following message to CBR in response to the letter I received from them above:

To the Center for Bio-Ethical Reform:

The pictures of dead and eviscerated babies you want to stop me from using are evidence of a horrible, ongoing holocaust that should be seen by every person in this nation. As a reporter and as an artist, it is my job to find every piece of evidence to this holocaust and bring it to the notice of the people of the world. In pursuit of that goal I have the right to fair use of every piece of evidence I find, no matter where I find it.

As the nationally known author and publisher of The Nuremberg Files, I was given by God the opportunity to show tens of millions of people in this nation and around the world that there are people here who are absolutely determined to outlaw abortion and prosecute those who persist in creating a holocaust like none the world has ever known.

You now say you own some of the best evidence ever found proving that holocaust, and you now forbid me to use that evidence in my work and threaten to haul me into court unless I sign some kind of contract giving you the right to dictate to me how I can use that evidence.

You are an affront to every serious crime reporter in the world, not to mention every artist. Who do you think you are to tell me how I can use some of the best evidence every found on this planet of this horrible atrocity presently occurring in this nation?

I don't know who you think you are, but your move to haul me into court and censor me proves who you are in truth.

Your letter proves the Center for Bio-Ethical Reform (CBR) is an example of those "pro-life" people who have turned the legalized murder of the unborn into a money-making venture. (It is public knowledge that CBR has sucked in a huge fortune). And like all profitable money making ventures, in order to survive, the Center for Bio-Ethical Reform must do whatever is necessary to ensure cash flow.

So that's your real problem with me: my work grows more effective each day that passes. The songs that you censored from Youtube were being seen by hundreds of people a day!

But it was not only the songs you censored from Youtube that created the threat to your abortion business.

As a current candidate for Governor of Georgia, whose songs were being seen by hundreds of people a day on Youtube, and whose articles were being read by hundreds more, I was beginning to create knowledge across the nation of a new and effective strategy with the power to abolish legalized abortion in our lifetime. This new offensive that we have launched created a real danger for anyone who makes their living, as you do, off the images of aborted babies. Under those circumstances, it is no surprise that you are trying to censor me and stop me from being used to arrest this evil in our midst. Unless I am stopped, the strategy I advocate will outlaw abortion and put you and your organization out of business, totally destroying your cash flow.

That is why you fight me in exactly the same way Planned Parenthood fights me.

And it is no exaggeration to say you fight me exactly like Planned Parenthood. "Pro-life" leaders like you are using the power of the federal government against me in exactly the same way, and with the same intent to destroy my work, as Planned Parenthood (PP) and the National Abortion Rights Action League (NARAL) and a long list of other leaders of the abortion industry.

I praise God you have decided to try stop me from using some the best evidence available concerning the horrible evil growing in this nation. Your attack against me just gives the Holy Spirit another opportunity to move people to think seriously about the work He has called me to do. I hope you continue in your court case against me so that everybody in the world can see with evidence that even the most ignorant person can understand exactly how the pro-life movement has become just another part of the abortion industry, committed like the rest of the abortion industry to doing whatever is necessary to perpetuate the cash flow accruing off the bodies of dead, eviscerated children of the Most High God.

In times and cultures past, there was a name for people who, like you, drew their sustenance from the flesh of dead people. They were called cannibals. It is a measure of the present delusion ruling the "pro-life" movement that even with the brief I now thrust before your eyes, you will probably not even get a slight taste of the dead babies you--the "pro-life" merchants--consume daily.

I have no doubt that God will damn all us cannibals to hell unless we repent. In the meantime--and it is a very mean time--expect me to fight you to the grave using every weapon the Most High God provides me with; for in that action I will model what real repentance looks like, up close and personal, and full of the Holy Spirit.

To help you see what's actually happening here, you need to understand CBR and my relationship with them and the rest of the leaders of the pro-life movement. So far the "pro-life" leaders have not managed to destroy all the things I have created to help people learn how to abolish legalized abortion. As you can see, if people will support me in that strategy, it is obvious that we would nullify in Georgia the laws that allow people to legally kill their unborn babies.

Think about what I advocate and you can begin to see why "pro-life" leaders would be doing everything in their power to prevent people from even knowing I am alive. They know that in everything I say and do the present cowardice of "pro-life" leaders is spotlighted with a light none of them wants to shine.

Take CBR as an example of all the well-funded "pro-life" groups who have managed one thing for 34 years--to keep abortion legal--and you will see what I mean.

CBR's modus operandi has been to create a monopoly on the ownership of the most powerful images of aborted babies on the planet, and then use that monopoly to condition people to tolerate legalized abortion.

Here's how they did that. In addition to gaining copyright of the most powerful images of babies dead from abortion, CBR began to force people to sign a contract submitting to CBR as the dictator for how the images are to be used.

Take me for example. Before CBR will give me permission to use their images, they require that I sign a contract. That contract says I will condemn "abortion related violence" and will not associate with anyone who refuses to condemn "abortion related violence."

But NO WHERE do they define "abortion related violence."

Do you see what happens when a person signs a contract to do things that are not clearly defined? That contract gives the contract holder the right to define the terms of the contract as things move forward in time. Such a contract has been proven from time immemorial to bind the conscience of signers and give the contract holder the power to subsequently control everything related to the contract.

In this situation, I would be in effect giving the Center for Bio-Ethical Reform veto power over everything I say or do in regard to something called "abortion related violence."

Since I am a candidate for the office of Governor of the State of Georgia, an office that requires me to be intensely involved in the use of what some dictionaries call "violence" and since my first priority as Governor focuses on abortion, I would be a total fool to sign some contract with CBR giving them the right to tell me what I can say and do about "abortion related" violence. Since I, by the grace of God, am no fool, I chose years ago, when CBR came out with their contract requirement, to refuse to sign it and instead exercise my right to fair use of a few of those images whenever my work called for them.

And make no mistake about it, I do have the right, under certain circumstances to use their copyrighted images in my work. It is a firmly established principle at law that a writer or reporter or artist has the right to fair use of copyrighted material under certain legal guidelines. My use of the images CBR is censoring me over matches those legal guidelines to the letter and spirit of the Fair Use Doctrine. But CBR has the money to pay for lawyers who can get the Internet to bow to their demands no matter what my rights under law if I am not able to defend those rights.

The question should come to your mind, Why would pro-life leaders be trying to censor Horsley? He seems to be sincerely trying to defend the babies.

Great question!

When the truth is known, CBR and the rest of the pro-life leaders are doing everything in their power to shut me up because, as amazing as it may sound, I have accumulated irrefutable evidence that pro-life leaders are literally all deriving their sustenance off the bodies of the aborted babies they claim to love. That's right, I am accusing them of being modern day cannibals. Not only do I accuse them of being cannibals, but I prove they, and you, and me, all of us, are in fact before God as sure as the sun came up this morning, cannibals.

Read it and I have no doubt you will see why the pro-life community in the nation--at least those who have actually heard what I am saying--hates me with all the fervor that closet cannibals can muster when they realize they've been outed.

I forward this exchange to you to see whether, in spite of being taken captive by Satan's wiles and turned into a cannibal, you will help me defend my Fair Use rights so we can break loose from our present abomination, or, if not, whether you can refer me to someone who will. As this reply should make clear, I intend to fight this to the end, no holds barred, and no quarter to be asked or given, because my Lord Jesus Christ did not raise me to be a cannibal.

I wish I had words that I knew would ensure your help, but I only have these. I pray they'll work if that's according to God's will.

You talk about having "intelligent discussion" after you have had my songs--the cries of my heart about babies being butchered--censored and shut down on the Internet.  There is no "intelligent discussion" to be had with people who are doing everything in their power to stop me from interposing in defense of babies being led to the slaughter.  There is only conflict, unending conflict until legalized abortion is arrested.
 
You say I have no real concern for babies being butchered but am driven by ego.  If I am driven by ego I am the stupidest man who ever lived because all I have gotten out of trying to stop people from butchering babies is attacks from people like you.  It is not ego that drives a man to pay everything he has got in defense of babies being led to the slaughter: it is love.  Did you hear that, Sutherland?  I'm not surprised you would not recognize the love that drives me because something else drives you.
 
You are exactly like the Pharisees: you wear your prayer shawl long and you sit in the best seat in the synagogues.  And, like the Priest and Levite who the Samaritan cleaned up after, you walk by babies dying in the ditch while you go to market the pictures of their slaughter.  And make no mistake about it, people know that whether you market those pictures for money or market them for controlling power over the consciences of other people, it is still marketing all the same.
 
And now you claim to own a copyright even over the messages you send to me.  You proved this when you told me that you were copyrighting the things you said to me and that I do "not have the right...to repeat them to [others]."  Do you know how bizarre it is to claim such a copyright in a confrontational message to a journalist like me?  No court in the land would honor such a specious and ultimately ridiculous copyright authority.  No wonder you claim copyright to the best evidence of the holocaust!  With such a totally false and private definition of copyright no wonder you and the others at CBR have set yourselves up as the "owners" of the best evidence of the holocaust raging around us.
 
Sutherland--and all the others at CBR--think what you will about me, but one thing you will know before this is over: I will fight your false claims to information that is relevant and needed in defending babies from unjust death.  I will fight you in every way my Lord Jesus Christ shows me.  And I will not quit fighting you and the people like you who derive your sustenance from the butchered bodies of dead babies, and who prove by every move you make that you have no intention of confessing that sin, much less repenting of it.

If anybody thinks I have ever written or said a word either in public or private indicating that I think people should be killing abortionists, it proves they get their information about me from Planned Parenthood and the rest of the leaders of the abortion industry, who have spread that vicious libel about me for years, instead of from my own lips.  I have always advocated abortionists be arrested and punished, not assassinated.
 
Since CBR has been on the forefront of spreading the vicious false witness about me that I advocate assassination and terrorism, and since the vast majority of the pro-life movement does not penalize pro-life groups like CBR who, when they bear false witness about me become nothing more than spokespeople for the point of view of the abortion industry, it is not surprising to find CBR finally doing in front of my face what they have been doing behind my back for years.
 
When the pro-life movement starts penalizing people like CBR instead of rewarding them with further support, I will believe the pro-life movement itself is something other than a very effective creation of the abortion industry, a creation designed to perpetuate legalized child sacrifice.  Until then, the ongoing presence of legalized abortion in this nation with its unending, horrible river of the bloody body parts of eviscerated babies will be the truth witness that defines the so-called "pro-life" movement.

If CBR is not being paid by Planned Parenthood and the other leaders of the abortion industry for censoring Neal Horsley's songs, they have a good reason to send the abortion industry a bill, because nobody in the abortion industry has been more effective in censoring work designed to stop people from killing little babies than the Center for Bio-Ethical Reform.
